Wir freuen uns, dass Sie sich für uns interessieren und sich für eine Stelle in unserem Unternehmen bewerben oder beworben haben. Wir möchten Ihnen nachfolgend gerne Informationen zur Verarbeitung Ihrer personenbezogenen Daten im Zusammenhang mit der Bewerbung erteilen.

Umgang mit Bewerberdaten

Wir bieten Ihnen die Möglichkeit, sich bei uns zu bewerben (z. B. per E-Mail, postalisch oder via Online-Bewerberformular). Im Folgenden informieren wir Sie über Umfang, Zweck und Verwendung Ihrer im Rahmen des Bewerbungsprozesses erhobenen personenbezogenen Daten. Wir versichern, dass die Erhebung, Verarbeitung und Nutzung Ihrer Daten in Übereinstimmung mit geltendem Datenschutzrecht und allen weiteren gesetzlichen Bestimmungen erfolgt und Ihre Daten streng vertraulich behandelt werden.

Umfang und Zweck der Datenerhebung

Wenn Sie uns eine Bewerbung zukommen lassen, verarbeiten wir Ihre damit verbundenen personenbezogenen Daten (z. B. Kontakt- und Kommunikationsdaten, Bewerbungsunterlagen, Notizen im Rahmen von Bewerbungsgesprächen etc.), soweit dies zur Entscheidung über die Begründung eines Beschäftigungsverhältnisses erforderlich ist. Rechtsgrundlage hierfür ist § 26 BDSG nach deutschem Recht (Anbahnung eines Beschäftigungsverhältnisses), Art. 6 Abs. 1 lit. b DSGVO (allgemeine Vertragsanbahnung) und – sofern Sie eine Einwilligung erteilt haben – Art. 6 Abs. 1 lit. a DSGVO. Die Einwilligung ist jederzeit widerrufbar. Ihre personenbezogenen Daten werden innerhalb unseres Unternehmens ausschließlich an Personen weitergegeben, die an der Bearbeitung Ihrer Bewerbung beteiligt sind.

Sofern die Bewerbung erfolgreich ist, werden die von Ihnen eingereichten Daten auf Grundlage von § 26 BDSG und Art. 6 Abs. 1 lit. b DSGVO zum Zwecke der Durchführung des Beschäftigungsverhältnisses in unseren Datenverarbeitungssystemen gespeichert.

Aufbewahrungsdauer der Daten

Sofern wir Ihnen kein Stellenangebot machen können, Sie ein Stellenangebot ablehnen oder Ihre Bewerbung zurückziehen, behalten wir uns das Recht vor, die von Ihnen übermittelten Daten auf Grundlage unserer berechtigten Interessen (Art. 6 Abs. 1 lit. f DSGVO) bis zu 6 Monate ab der Beendigung des Bewerbungsverfahrens (Ablehnung oder Zurückziehung der Bewerbung) bei uns aufzubewahren. Anschließend werden die Daten gelöscht und die physischen Bewerbungsunterlagen vernichtet. Die Aufbewahrung dient insbesondere Nachweiszwecken im Falle eines Rechtsstreits. Sofern ersichtlich ist, dass die Daten nach Ablauf der 6-Monatsfrist erforderlich sein werden (z. B. aufgrund eines drohenden oder anhängigen Rechtsstreits), findet eine Löschung erst statt, wenn der Zweck für die weitergehende Aufbewahrung entfällt.

Eine längere Aufbewahrung kann außerdem stattfinden, wenn Sie eine entsprechende Einwilligung (Art. 6 Abs. 1 lit. a DSGVO) erteilt haben oder wenn gesetzliche Aufbewahrungspflichten der Löschung entgegenstehen.

Aufnahme in den Bewerber-Pool

Sofern wir Ihnen kein Stellenangebot machen, besteht ggf. die Möglichkeit, Sie in unseren Bewerber-Pool aufzunehmen. Im Falle der Aufnahme werden alle Dokumente und Angaben aus der Bewerbung in den Bewerber-Pool übernommen, um Sie im Falle von passenden Vakanzen zu kontaktieren.

Die Aufnahme in den Bewerber-Pool geschieht ausschließlich auf Grundlage Ihrer ausdrücklichen Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Die Abgabe der Einwilligung ist freiwillig und steht in keinem Bezug zum laufenden Bewerbungsverfahren. Der Betroffene kann seine Einwilligung jederzeit widerrufen. In diesem Falle werden die Daten aus dem Bewerber-Pool unwiderruflich gelöscht, sofern keine gesetzlichen Aufbewahrungsgründe vorliegen.

Die Daten aus dem Bewerber-Pool werden spätestens zwei Jahre nach Erteilung der Einwilligung unwiderruflich gelöscht.

Datenschutzinformationen für Geschäftspartner der poe GmbH & Co. KG

Der Schutz Ihrer persönlichen Daten ist uns ein besonderes Anliegen. Wir verarbeiten Ihre personenbezogenen Daten (kurz „Daten“) daher ausschließlich auf Grundlage der gesetzlichen Bestimmungen. Mit dieser Datenschutzerklärung wollen wir Sie über die Verarbeitung Ihrer Daten in unserem Unternehmen und die Ihnen zustehenden datenschutzrechtlichen Ansprüche und Rechte umfassend im Sinne der Europäischen Datenschutz-Grundverordnung (EU DS-GVO) informieren.

1. Wer ist für die Datenverarbeitung verantwortlich und an wen können Sie sich wenden?

Der betriebliche Datenschutzbeauftragte der poe GmbH & Co. KG, Herr Paul Köhler ist unter der genannten Anschrift oder per E-Mail unter datenschutz@bitsic.de zu erreichen.  

2. Welche Daten werden verarbeitet und aus welchen Quellen stammen diese Daten? 

Wir verarbeiten die Daten, die wir im Rahmen der Geschäftsanbahnung und -beziehung von Ihnen erhalten. Zudem verarbeiten wir Daten, die wir von Auskunfteien, Gläubigerschutzverbänden, aus öffentlich zugänglichen Quellen (z.B. Unternehmensregister, Vereinsregister, Grundbuch, Medien) sowie sonstigen Unternehmen, mit denen wir in dauerhafter Geschäftsbeziehung stehen, zulässigerweise erhalten haben.

Zu den personenbezogenen Daten zählen:

Ihre Stamm-/Kontaktdaten, hierzu zählen bei Privatkunden z.B. Vor- und Zuname, Adresse, Kontaktdaten (E-Mail-Adresse, Telefonnummer, Fax), Geburtsdatum, Daten aus vorgelegtem Identitätsnachweis (Ausweiskopie), Bankdaten. Bei Firmenkunden zählen hierzu z.B. die Bezeichnung ihrer rechtsgeschäftlichen Vertreter, Firma, Handelsregisternummer, Umsatzsteuer-IdNr., Betriebsnummer, Adresse, Ansprechpartner-Kontaktdaten (E-Mail-Adresse, Telefonnummer, Fax), Bankdaten.

Darüber hinaus verarbeiten wir auch folgende sonstige personenbezogene Daten:

  • Informationen über Art und Inhalt unserer Geschäftsbeziehung wie Vertragsdaten, Auftragsdaten, Umsatz- und Belegdaten, Kunden- und Lieferantenhistorie sowie Beratungsunterlagen,
  • Informationen über Ihren Finanzstatus (z.B. Bonitätsdaten),
  • Werbe- und Vertriebsdaten,
  • Dokumentationsdaten (z.B. Beratungsprotokolle), Bilddaten,
  • Informationen aus Ihrem elektronischen Verkehr mit der poe GmbH & Co. KG  
    (z.B. IP-Adresse, Log-in-Daten), 
  • sonstige Daten, die wir von Ihnen im Rahmen unserer Geschäftsbeziehung (z.B. in Kundengesprächen) erhalten haben,
  • Daten, die wir aus Stamm- / Kontaktdaten sowie sonstigen Daten selbst generieren, wie z.B. mittels Kundenbedarfs- und Kundenpotentialanalysen,
  • Die Dokumentation Ihrer Zustimmungserklärung für den Erhalt von z.B. Newslettern.

3. Für welche Zwecke und auf welcher Rechtsgrundlage werden die Daten verarbeitet?

Wir verarbeiten Ihre Daten im Einklang mit den Bestimmungen der Datenschutz-Grundverordnung (DS-GVO) und dem Bundesdatenschutzgesetz 2018 in der jeweils geltenden Fassung: 

a) zur Erfüllung von (vor-)vertraglichen Pflichten (Art 6 Abs. 1lit.b DS-GVO):

Die Verarbeitung Ihrer Daten erfolgt für den Verkauf und Vertrieb unserer Waren und Dienstleistungen (Anlage und Führen eines Kundenkontos), zu Beschaffungs- und Logistikzwecken (Auslieferung von Bestellungen) sowie zur Kundenverwaltung und Analyse. Die Daten werden insbesondere bei Geschäftsanbahnung und bei Durchführung der Verträge mit Ihnen verarbeitet.  

b) zur Erfüllung rechtlicher Verpflichtungen (Art 6 Abs. 1lit.c DS-GVO):

Eine Verarbeitung Ihrer Daten ist zum Zweck der Erfüllung unterschiedlicher gesetzlicher Verpflichtungen z.B. aus dem Handelsgesetzbuch oder der Abgabenordnung, Geldwäschebestimmungen, produktspezifischen Regelungen wie etwa der Gefahrstoffverordnung erforderlich.

c) zur Wahrung berechtigter Interessen (Art 6 Abs. 1 lit.f DS-GVO):

Aufgrund einer Interessenabwägung kann eine Datenverarbeitung über die eigentliche Erfüllung des Vertrags hinaus zur Wahrung berechtigter Interessen von uns oder Dritten erfolgen. Eine Datenverarbeitung zur Wahrung berechtigter Interessen erfolgt beispielsweise in folgenden Fällen:

  • Konsultation von und Datenaustausch mit Auskunfteien und Gläubigerschutz-vereinigungen zur Ermittlung von Bonitätsdaten sowie das Führen einer firmenweiten Bonitätsdatenbank zur Identifizierung finanzieller Ausfallrisiken bei gemeinsamen Kunden (siehe Nr. 5),
  • Werbung oder Marketing (siehe Nr. 4), 
  • Maßnahmen zur Geschäftssteuerung und Weiterentwicklung von Dienstleistungen und Produkten,
  • Führen einer firmenweiten Kundendatenbank zur Verbesserung des Kundenservice (siehe Nr. 6),
  • im Rahmen der Rechtsverfolgung.

d) im Rahmen Ihrer Einwilligung (Art 6 Abs. 1lit.a DSGVO):

Wenn Sie uns eine Einwilligung zur Verarbeitung Ihrer Daten erteilt haben, erfolgt eine Verarbeitung nur gemäß den in der Einwilligungserklärung festgelegten Zwecken und im darin vereinbarten Umfang. Eine erteilte Einwilligung kann jederzeit mit Wirkung für die Zukunft widerrufen werden, z.B. zur Zusendung unseres Newsletters. Wenden Sie sich hierzu bitte an die unter Nr. 1 genannten Ansprechpartner. 

4. Verarbeitung personenbezogener Daten zu Werbezwecken

Wir nutzen Ihre Daten auch, um mit Ihnen über Ihre Bestellungen, bestimmte Produkte oder Marketingaktionen zu kommunizieren und Ihnen Produkte oder Dienstleistungen zu empfehlen, die Sie interessieren könnten. 

Der Verwendung Ihrer personenbezogenen Daten für Werbezwecke können Sie jederzeit insgesamt oder für einzelne Maßnahmen widersprechen, ohne dass hierfür andere als die Übermittlungskosten nach den Basistarifen entstehen. Wenden Sie sich hierzu bitte an die unter Nr. 1 genannten Ansprechpartner.

a) Produktempfehlungen per E-Mail

Die poe GmbH & Co. KG ist unter den gesetzlichen Voraussetzungen des § 7 Abs.3 UWG berechtigt, die E-Mail-Adresse, die Sie bei der Bestellung eines Produktes oder einer Dienstleistung angegeben haben, zur Direktwerbung für eigene ähnliche Waren oder Dienstleistungen zu nutzen. Diese Produktempfehlungen erhalten Sie von uns unabhängig davon, ob Sie einen Newsletter abonniert haben.

Wenn Sie keine Produktempfehlungen per E-Mail von uns erhalten möchten, können Sie der Verwendung Ihrer Adresse zu diesem Zweck jederzeit widersprechen, ohne dass hierfür andere als die Übermittlungskosten nach den Basistarifen entstehen. Eine Mitteilung in Textform reicht hierfür aus, wenden Sie sich hierzu bitte an die unter Nr. 1 genannten Ansprechpartner. Selbstverständlich ist in jeder E-Mail immer auch ein Abmeldelink enthalten.

5. Bonitätsinformationen

Datenübermittlung an Wirtschaftsauskunfteien und Inkassodienstleister

Die poe GmbH & Co. KG übermittelt im Rahmen dieses Vertragsverhältnisses erhobene personenbezogene Daten über die Beantragung, die Durchführung und Beendigung dieser Geschäftsbeziehung sowie Daten über nicht vertragsgemäßes Verhalten oder betrügerisches Verhalten an verschiedene Wirtschaftsauskunfteien und Inkassodienstleister. Rechtsgrundlagen dieser Übermittlungen sind Artikel 6 Absatz 1 Buchstabe b und Artikel 6 Absatz 1 Buchstabe f der Datenschutz-Grundverordnung (DSGVO). Übermittlungen auf der Grundlage von Artikel 6 Absatz 1 Buchstabe f DS-GVO dürfen nur erfolgen, soweit dies zur Wahrung berechtigter Interessen der poe GmbH & Co. KG oder Dritter erforderlich ist und nicht die Interessen oder Grundrechte und Grundfreiheiten der betroffenen Person, die den Schutz personenbezogener Daten erfordern, überwiegen. Der Datenaustausch mit den Wirtschaftsauskunfteien und Inkassodienstleistern dient auch der Erfüllung gesetzlicher Pflichten zur Durchführung von Kreditwürdigkeitsprüfungen von Kunden (§ 505a und 506 des Bürgerlichen Gesetzbuches). Die Wirtschaftsauskunfteien und Inkassodienstleister verarbeiten die erhaltenen Daten und verwenden sie ggf. auch zum Zwecke der Profilbildung (Scoring), um ihren Vertragspartnern im Europäischen Wirtschaftsraum und in der Schweiz sowie ggf. weiteren Drittländern (sofern zu diesen ein Angemessenheitsbeschluss der Europäischen Kommission besteht) Informationen unter anderem zur Beurteilung der Kreditwürdigkeit von natürlichen Personen zu geben.

6. Wer erhält meine Daten? 

Wenn wir einen Dienstleister im Sinn einer Auftragsverarbeitung einsetzen, bleiben wir dennoch für den Schutz Ihrer Daten verantwortlich. Sämtliche Auftragsverarbeiter sind vertraglich dazu verpflichtet, Ihre Daten vertraulich zu behandeln und nur im Rahmen der Leistungserbringung zu verarbeiten. Die von uns beauftragten Auftragsverarbeiter erhalten Ihre Daten, sofern diese die Daten zur Erfüllung ihrer jeweiligen Leistung benötigen. Diese sind z.B. IT- Dienstleister, die wir für Betrieb und Sicherheit unseres IT-Systems benötigen sowie Werbe- und Adressenverlage für eigene Werbeaktionen.

Ihre Daten werden in der poe-Kundendatenbank verarbeitet. Die poe-Kundendatenbank unterstützt die Anhebung der Datenqualität der vorhandenen Kundendaten (Dubletten Bereinigung, Verzogen/Verstorben-Kennzeichen, Adresskorrektur), und ermöglicht die Anreicherung mit Daten aus öffentlichen Quellen. Diese Daten werden den gegebenenfalls vorhandenen Tochtergesellschaften der poe GmbH & Co. KG, die an der poe-Kundendatenbank teilnehmen (teilnehmende Gesellschaften), zur Verfügung gestellt und können für personalisierte Direktmarketing Aktionen (z.B. Newsletter), für gezieltes Online-Marketing und personalisierte Online-Shop Gestaltung, verwendet werden.  Durch die poe-Kundendatenbank sollen teilnehmende Gesellschaften, welche die gleichen Kunden betreuen, Informationen über diese Kunden organisationsübergreifend nutzen können. Diese Vorgehensweise hat das Ziel, den Kunden stets die aktuelle und relevanteste Information bereit zu stellen. Diese Verarbeitung von Kundeninteressen stellt Profiling im Sinne von Art. 4 DS-GVO dar; eine automatisierte Entscheidungsfindung erfolgt nicht. Das Speichern von Kundendaten erfolgt unternehmensbezogen und getrennt, wobei die poe GmbH & Co. KG für die einzelnen teilnehmenden Gesellschaften als Dienstleister fungiert.

Eine Übersicht über die Tochtergesellschaften der poe GmbH & Co. KG werden auf Anfrage zur Verfügung gestellt.

Erfolgt eine Angebotslegung/Verkauf über Herstellerportale, werden von Ihnen bekanntgegebene Daten direkt im Portal des Herstellers verarbeitet. 

Bei Vorliegen einer gesetzlichen Verpflichtung sowie im Rahmen der Rechtsverfolgung können Behörden und Gerichte sowie externe Auditoren Empfänger Ihrer Daten sein.

Darüber hinaus können zum Zweck der Vertragsanbahnung und -erfüllung Versicherungen, Banken, Auskunfteien und Dienstleister Empfänger Ihrer Daten sein.

7. Wie lange werden meine Daten gespeichert?

Wir verarbeiten Ihre Daten bis zur Beendigung der Geschäftsbeziehung oder bis zum Ablauf der geltenden Garantie-, Gewährleistungs-, Verjährungs- und gesetzlichen Aufbewahrungsfristen (etwa aus dem Handelsgesetzbuch oder der Abgabenordnung); darüber hinaus bis zur Beendigung von allfälligen Rechtsstreitigkeiten, bei denen die Daten als Beweis benötigt werden. 

8. Werden personenbezogene Daten an ein Drittland übermittelt?

Grundsätzlich werden von uns keine Daten an ein Drittland übermittelt. Eine Übermittlung findet im Einzelfall nur auf Grundlage eines Angemessenheitsbeschlusses der Europäischen Kommission, Standardvertragsklauseln, geeigneter Garantien oder Ihrer ausdrücklichen Zustimmung statt.

9. Welche Datenschutzrechte habe ich?

Sie haben jederzeit ein Recht auf Auskunft, Berichtigung, Löschung oder Einschränkung der Verarbeitung Ihrer gespeicherten Daten, ein Widerspruchsrecht gegen die Verarbeitung sowie ein Recht auf Datenübertragbarkeit und auf Beschwerde gemäß den Voraussetzungen des Datenschutzrechts. 

 Auskunftsrecht: 

Sie können von uns eine Auskunft verlangen, ob und in welchem Ausmaß wir Ihre Daten verarbeiten.

 Recht auf Berichtigung: 

Verarbeiten wir Ihre Daten, die unvollständig oder unrichtig sind, so können Sie jederzeit deren Berichtigung bzw. deren Vervollständigung von uns verlangen.

 Recht auf Löschung: 

Sie können von uns die Löschung Ihrer Daten verlangen, sofern wir diese unrechtmäßig verarbeiten oder die Verarbeitung unverhältnismäßig in Ihre berechtigten Schutzinteressen eingreift. Bitte beachten Sie, dass es Gründe geben kann, die einer sofortigen Löschung entgegenstehen, z.B. im Fall von gesetzlich geregelten Aufbewahrungspflichten. Unabhängig von der Wahrnehmung Ihres Rechts auf Löschung, werden wir Ihre Daten umgehend und vollständig löschen, soweit keine diesbezügliche rechtsgeschäftliche oder gesetzliche Aufbewahrungspflicht entgegensteht.

 Recht auf Einschränkung der Verarbeitung: 

Sie können von uns die Einschränkung der Verarbeitung Ihrer Daten verlangen, wenn

  • Sie die Richtigkeit der Daten bestreiten, und zwar für eine Dauer, die es uns ermöglicht, die Richtigkeit der Daten zu überprüfen.
  • die Verarbeitung der Daten unrechtmäßig ist, Sie aber eine Löschung ablehnen und stattdessen eine Einschränkung der Datennutzung verlangen,
  • wir die Daten für den vorgesehenen Zweck nicht mehr benötigen, Sie diese Daten aber noch zur Geltendmachung oder Verteidigung von Rechtsansprüchen brauchen, oder Sie Widerspruch gegen die Verarbeitung der Daten eingelegt haben.

 Recht auf Datenübertragbarkeit: 

Sie können von uns verlangen, dass wir Ihnen Ihre Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format zur Verfügung stellen und dass Sie diese Daten einem anderen Verantwortlichen ohne Behinderung durch uns übermitteln können, sofern

  • wir diese Daten aufgrund einer von Ihnen erteilten und widerrufbaren Zustimmung oder zur Erfüllung eines Vertrages zwischen uns verarbeiten, und
  • diese Verarbeitung mithilfe automatisierter Verfahren erfolgt.

Bei technischer Machbarkeit können Sie von uns eine direkte Übermittlung Ihrer Daten an einen anderen Verantwortlichen verlangen.

Widerspruchsrecht: 

Verarbeiten wir Ihre Daten aus berechtigtem Interesse, so können Sie gegen diese Datenverarbeitung aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit Widerspruch einlegen; dies gilt auch für ein auf diese Bestimmungen gestütztes Profiling. Wir verarbeiten dann Ihre Daten nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen. Der
Verarbeitung Ihrer Daten zum Zweck der Direktwerbung können Sie jederzeit ohne Angabe von Gründen widersprechen.

Beschwerderecht: 

Sind Sie der Meinung, dass wir bei der Verarbeitung Ihrer Daten gegen deutsches oder europäisches Datenschutzrecht verstoßen, so bitten wir Sie, mit uns Kontakt aufzunehmen, um Fragen aufklären zu können. Sie haben selbstverständlich auch das Recht, sich an die für die poe GmbH & Co. KG zuständige Aufsichtsbehörde, die Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, zu wenden.

Sofern Sie eines der genannten Rechte uns gegenüber geltend machen wollen, so wenden Sie sich hierzu bitte an die unter Nr. 1 genannten Ansprechpartner. Im Zweifel können wir zusätzliche Informationen zur Bestätigung Ihrer Identität anfordern. 

10. Bin ich zur Bereitstellung von Daten verpflichtet?

Die Verarbeitung Ihrer Daten ist zum Abschluss bzw. zur Erfüllung Ihres mit uns eingegangenen Vertrages erforderlich. Wenn Sie uns diese Daten nicht zur Verfügung stellen, werden wir den Abschluss des Vertrags oder die Ausführungen des Auftrags in der Regel ablehnen müssen oder einen bestehenden Vertrag nicht mehr durchführen können und folglich beenden müssen. Sie sind jedoch nicht verpflichtet, hinsichtlich für die Vertragserfüllung nicht relevanter bzw. gesetzlich nicht erforderlicher Daten eine Einwilligung zur Datenverarbeitung zu erteilen.

Information on data transfer to the USA and other non-EU countries

8. Online-based Audio and Video Conferences (Conference tools)

Data processing

We use online conference tools, among other things, for communication with our customers. The tools we use are listed in detail below. If you communicate with us by video or audio conference using the Internet, your personal data will be collected and processed by the provider of the respective conference tool and by us. The conferencing tools collect all information that you provide/access to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).

Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Should content be exchanged, uploaded, or otherwise made available within the tool, it is also stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/ instant messages, voicemail uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have complete influence on the data processing procedures of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, and which we have listed below this text.

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest in the meaning of Art. 6(1)(f) GDPR). We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract mandated by data privacy laws that guarantees that they process personal data of our website visitors only based on our instructions and in compliance with the GDPR.

9. Custom Services

Handling applicant data

We offer website visitors the opportunity to submit job applications to us (e.g., via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing, and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g., contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 BDSG according to German Law (Negotiation of an Employment Relationship), Art. 6(1)(b) GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6(1)(a) GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6(1)(a) GDPR) or if statutory data retention requirements preclude the deletion.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. In case of admission, all documents and information from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

Admission to the applicant pool is based exclusively on your express agreement (Art. 6(1)(a) GDPR). The submission agreement is voluntary and has no relation to the ongoing application procedure. The affected person can revoke his agreement at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for storage.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

Data processing through social networks

We maintain publicly available profiles in social networks. The individual social networks we use can be found below.

Social networks such as Facebook, Twitter etc. can generally analyze your user behavior comprehensively if you visit their website or a website with integrated social media content (e.g., like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered. In detail:

If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

Using the data collected in this way, the operators of the social media portals can create user profiles in which their preferences and interests are stored. This way you can see interest-based advertising inside and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device you are logged in to or have logged in to.

Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media portals. Legal basis

Our social media appearances should ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on divergent legal bases to be specified by the operators of the social networks (e.g., consent within the meaning of Art. 6 (1) (a) GDPR).

Responsibility and assertion of rights

If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can in principle protect your rights (information, correction, deletion, limitation of processing, data portability and complaint) vis-à-vis us as well as vis-à-vis the operator of the respective social media portal (e.g., Facebook).

Please note that despite the shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are determined by the company policy of the respective provider.

Storage time

The data collected directly from us via the social media presence will be deleted from our systems as soon as you ask us to delete it, you revoke your consent to the storage or the purpose for the data storage lapses. Stored cookies remain on your device until you delete them. Mandatory statutory provisions - in particular, retention periods - remain unaffected.

We have no control over the storage duration of your data that are stored by the social network operators for their own purposes. For details, please contact the social network operators directly (e.g., in their privacy policy, see below).

Your rights

You have the right to receive information about the origin, recipient and purpose of your stored personal data at any time and free of charge. You also have the right to object, the right to data portability and the right to file a complaint with the responsible regulatory agency. Furthermore, you can request the correction, blocking, deletion and, under certain circumstances, the restriction of the processing of your personal data.
